This website, roakewaka.com, and the Roake Waka brand are operated by ROAKE WAKA LIMITED, a company registered in New Zealand under company number 1923276 (NZBN 9429033518589).

Our registered address is 22 Salisbury Street, Christchurch Central, Christchurch 8013, New Zealand. You can reach us at support@roakewaka.com. In these terms, references to we, us and our mean ROAKE WAKA LIMITED, and references to you mean the person placing an order or using the site.

Formation of Contract

All orders placed through our website are an offer by you to purchase the products selected, subject to these terms. Displaying products on the site is an invitation to treat, not a binding offer to sell.

A contract between you and us is formed only when we send you an order confirmation email accepting your order and confirming that it has been processed for fulfilment. If we are unable to accept your order, for example because an item is out of stock, a pricing error has occurred, or we cannot ship to your location, we will notify you and refund any payment already taken.

Eligibility

To place an order you must be at least 18 years old, or the age of majority in your jurisdiction, and able to enter into a legally binding contract. By ordering you confirm that you meet this requirement and that the information you provide is accurate and complete.

Water sports equipment must only be used by, or under the supervision of, a responsible adult. Use by minors is subject to the supervision requirements in our Acceptable Use policy.

Pricing and Payment

All prices on the site are quoted in United States Dollars (USD) and are payable in USD. Prices are inclusive of the product only; shipping charges and any applicable import duties or taxes are additional and are described in our Shipping Policy.

All purchases are one-time payments. We do not operate subscriptions, memberships or recurring billing of any kind. Payments are processed securely by Stripe; we do not store your full card number on our systems. We make reasonable efforts to ensure pricing is accurate, but if a clear pricing error is identified we reserve the right to cancel the affected order and refund you in full.

Products Are for Recreational Use Only

Roake Waka kits and the equipment within them are sold for recreational and leisure use by amateurs only. They are not certified, rated or intended for professional, commercial, competition, military, emergency-response or search-and-rescue use.

Product images, kit contents and descriptions are provided for guidance. Colours, components and packaging may vary, and we may substitute an item of equal or greater value where necessary. You are responsible for confirming that a kit is suitable for your intended activity, your experience level and the conditions you will face. Please read our Acceptable Use policy before using any equipment.

Intellectual Property

All content on roakewaka.com, including text, graphics, logos, photographs, illustrations, guides, the Roake Waka name and the overall site design, is owned by or licensed to ROAKE WAKA LIMITED and is protected by intellectual property laws.

You may view and use the site for your own personal, non-commercial purposes. You may not copy, reproduce, republish, distribute or exploit any part of the site for commercial purposes without our prior written permission.

Warranty

We warrant that products will be free from material defects in materials and workmanship under normal recreational use at the time of delivery. This warranty does not cover damage caused by misuse, accident, modification, normal wear and tear, improper storage, or failure to follow care and usage instructions.

Where you deal with us as a consumer in New Zealand, the guarantees under the Consumer Guarantees Act 1993 apply in addition to this warranty and are not excluded by it. Nothing in these terms limits any right you have that cannot lawfully be excluded.

Limitation of Liability

Water-based activities carry inherent risks, including drowning, injury and death. To the maximum extent permitted by law, we are not liable for any loss, injury or damage arising from your use of, or inability to use, the equipment, including any failure to wear safety equipment or to follow our Acceptable Use policy.

To the extent permitted by law, our total liability arising out of or in connection with any order is limited to the amount you paid for the product giving rise to the claim. We are not liable for indirect, incidental or consequential loss. Nothing in this clause excludes or limits liability that cannot lawfully be excluded, including under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.

Force Majeure

We are not responsible for any delay or failure to perform our obligations where that delay or failure is caused by events beyond our reasonable control, including natural disasters, severe weather, fire, flood, earthquake, pandemic, war, civil unrest, labour disputes, carrier failures, customs delays or interruptions to power, telecommunications or supply chains.

Governing Law and Dispute Resolution

These terms and any dispute or claim arising out of or in connection with them, their subject matter or formation are governed by and construed in accordance with the laws of New Zealand.

You and we submit to the exclusive jurisdiction of the courts of New Zealand. Before commencing proceedings, we encourage you to contact us at support@roakewaka.com so we can try to resolve the matter directly and in good faith.

Severability and Contact

If any provision of these terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect. Our failure to enforce any right does not waive that right.
